Terms of Service

1. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service on devices you own or control, for your personal or internal business purposes.

You may not:

• Copy, modify, or create derivative works of the Service.
• Reverse engineer, decompile, or disassemble the Service, except to the extent applicable law expressly permits it.
• Rent, lease, sell, sublicense, or otherwise transfer your rights to the Service.
• Remove or obscure any proprietary notices.

2. Your Content and Ownership

You own your content. Photos, videos, notes, captions, and project data you create or upload remain yours. We claim no ownership over them.

You grant us a limited license to host, store, transmit, display, and back up your content solely for the purpose of operating the Service for you — for example, syncing a photo between your devices or showing it to a collaborator you invited. This license exists only to run the Service and ends when you delete the content or your account, subject to routine backup rotation.

We do not use your content to train AI models, and we do not use it for advertising.

You are responsible for your content, including having the rights necessary to capture and upload it and complying with any law that applies to it.

3. Accounts

• You must provide accurate information when creating an account.
• You are responsible for activity that occurs under your account and for keeping your credentials secure.
• You must be at least 13 years old to use the Service. The Service is not directed to children under 13.
• If you create a team or invite collaborators, you are responsible for who you grant access to and for what they do with that access.

4. Acceptable Use

You agree not to use the Service to:

• Violate any law or infringe anyone's rights.
• Capture or upload content of a person in a place or manner where they have a reasonable expectation of privacy, without their consent.
• Upload malware or attempt to compromise the Service or other users' accounts.
• Circumvent usage limits, access controls, or authentication, or access data that is not yours.
• Store regulated data the Service is not designed for, including Protected Health Information and Criminal Justice Information. See our Trust Center.
• Resell or provide the Service to third parties as a standalone commercial offering.

We may suspend or terminate accounts that violate this section.

5. Timestamps and Accuracy

The Service records timestamps, location data, weather, and similar metadata using information supplied by your device and third-party data sources. While we work to make these accurate, we do not warrant that any timestamp, location, or other metadata is accurate, complete, tamper-proof, or admissible as evidence in any legal or regulatory proceeding. You are responsible for determining whether the Service is suitable for your intended use.

6. Subscriptions and Billing

• The Service offers free and paid tiers. Paid subscriptions are purchased through the Apple App Store or Google Play, and those platforms — not ShabzCo — process your payment.
• Subscriptions renew automatically until cancelled. You manage and cancel your subscription through your App Store or Google Play account settings.
• Refunds are handled by the platform you purchased through, under their policies. We cannot issue refunds for store purchases directly.
• We may change pricing for future billing periods. We will give notice before a change takes effect for an existing subscription.

7. Service Changes and Availability

We may add, change, or discontinue features. We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. Maintenance, third-party outages, and app store review timelines can all affect availability. See our availability and support information.

8. Termination

• You may stop using the Service and delete your account at any time.
• We may suspend or terminate your access if you materially breach these Terms, or if required by law.
• On termination, you may export your content before deleting your account. After account deletion, your data is removed from active systems as described in the Privacy Policy.
• Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and governing law — will survive.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DATA WILL NOT BE LOST.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHABZCO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow these limitations, so they may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless ShabzCo, LLC and its officers, members, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your content, your use of the Service, or your violation of these Terms or applicable law.

12. Apple and Google Provisions

• These Terms are between you and ShabzCo, LLC only — not with Apple or Google.
• Apple and Google have no obligation to provide maintenance or support for the Service.
• Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-party list.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of ⚠ NEEDS INPUT: state of incorporation / principal place of business, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in ⚠ NEEDS INPUT: county and state for venue, and you consent to personal jurisdiction there.

If you are a U.S. federal, state, or local government entity, provisions that conflict with applicable law governing your procurement do not apply to the extent of the conflict.

14. General

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
• Severability. If any provision is unenforceable, the rest remains in effect.
• No waiver. Our failure to enforce a provision is not a waiver of it.
• Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• Changes. We may update these Terms. Material changes will be posted here with an updated effective date and, where appropriate, communicated to account holders by email. Continued use after changes take effect constitutes acceptance.
